Working Report of Legislative Councilor Samson Tam Wai Ho (Information Technology) (October 2009) I. Focus Updates 1. Delegation trip to study the policies and legislation of Digital Taiwan 考察數碼化台灣的政策與法例 I led a delegation to visit Taipei in early October for the purpose of understanding the development of interactive digital-government of Taiwan in the Internet Age. The following points are worth mentioning: Establishing an interactive digital-government: I visited The Research, Development and Evaluation Commission of the Executive Yuan and learnt that Taiwan had been promoting digital-government for more than ten years. The network infrastructure had been completed. Taiwan is committed to realise digital governance of a vital government, so as to create an “Intelligent Taiwan”. As we know, Taiwan government officials are all equipped with e-mail to communicate with the public and the Government also promotes digital interactive network in the community. I have been promoting e-Government all the time and also suggested to include it in the Digital 21 Strategy. The experience of Taiwan definitely serves as our reference. A good mechanism for protecting Intellectual Property: The visit to the Intellectual Property Office was to learn more about the latest revision of the Intellectual Property law. In fact, Taiwan Government has allocated a lot of resources in this respect. It includes the establishment of a staff of more than a hundred people responsible for examining and registration of trademark and copyright. They even have special court to deal with the ‘intellectual property’ cases. I believe, in the progress to a knowledge-based economy, there is considerable room of co-operation between Taiwan and Hong Kong on Intellectual Property Protection matters. High-level technology consultation and decision-making framework: Why can Taiwan continue to promote technological development and achieve good results? The answer lies with the establishment of the Science and Technology Advisory Group under the Executive Yuan. It does not only engage internationally famous experts and scholars to be technology advisors, but also appoints the Premier as the convener. Moreover, an inter-ministry Executive Member is put in-charge, and all departments are requested to take part in formulating policies. Since the Science and Technology Bureau no longer exists in Hong Kong, the Executive Council should seriously consider appointing an Executive Member who is responsible for technology policies.
2. Responses to Six Industries in the Policy Address 對施政報告有關六大產業的回應
Following the release of the new Policy Address, I immediately organized an Expert Group discussion forum to gauge the response of the IT industry. The views expressed were:
to develop the Six Industries via the ICT platform; to include software testing in the Testing and Certification Services; to include distance interactive learning as an important part of Education Services;
to promote the development of Data Centre through the activation of industrial buildings; to use IT to enhance energy efficiency; Government should provide a one-stop platform to assist SMEs to explore the Mainland market.
I think that the Chief Executive should change the theme of “Breaking New Ground Together” to “Creating New Jobs Together”. Through creating more quality jobs, let our citizens demonstrate their talents and share the fruit of economic development. Your comments on the Policy Address are welcome I will continue to reflect the views of the IT Industry to the Government and other LegCo members. 3. Completed the deliberations of the Bills Committee on Copyright (Amendment) Bill 2009 完成《2009年版權〈修訂〉條例草案》的審議
I was elected as Chairman of the Bills Committee at the meeting on 21 May. Deliberations on the Amendment Bill were completed after six meetings. The Administration proposed to resume the Second Reading of this Bill on 18 November 2009. 4. Organized public consultation forum on “Personal Data (Privacy) Ordinance” with industries 與業界舉辦《個人資料(私隱)條例》公眾諮詢研討會
Together with several professional bodies, my LegCo office held public consultation forum on the “Personal Data (Privacy) Ordinance” on 5 October. The participants included representatives from the Government, NGO, IT industry and Parent-Teacher Association. The participants suggested that the Government should allay public concerns on the following issues:
As IT personnel have to handle a great deal of personal data, will the amendments increase their risk of offending the law? If biometric identification data are classified as sensitive information, will the legislation hinder the development of biometric identification technology in Hong Kong? How can organizations and enterprises cope with the crisis of information leakage? Under what circumstances will parents have the right to access children’s personal data?
I hope that the Privacy Commission should strengthen communication and co-operation with various stakeholders. 5. Elected as the Chairman of Panel on Information Technology and Broadcasting, following- up on major issues 獲選立法會資訊科技及廣播事務委員會主席,跟進重點議題
I was elected as the Chairman at the meeting of the Panel on Information Technology and Broadcasting on 15 October. In the coming year, there are many important issues to be resolved. These include Public Broadcasting Services and the Future of Radio Hong Kong, the establishment of the Communications Authority as the single broadcasting and telecommunications regulatory agency, the second round of public consultation of the Control of Obscene and Indecent Articles Ordinance, and the mid-term review of the domestic free television programme service licences. Both the industries and the general public are very concerned about these issues, so I look forward to your continued support and assistance. II.
